DMCA Notice & Takedown Policy

1. Overview
MyAlbumLink ("we", "us", "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to valid notices of alleged copyright infringement reported to our Designated Agent.
This page describes how copyright owners can submit a takedown notice, how affected users can respond with a counter-notification, and our policy for terminating repeat infringers.
2. Designated Copyright Agent
Notices of claimed copyright infringement must be sent to our Designated Agent, registered with the U.S. Copyright Office:
Our current registered agent information is also available in the public directory of the U.S. Copyright Office at dmca.copyright.gov. Notices sent to any address other than our Designated Agent may not receive a response.
3. How to File a Copyright Infringement Notice
To be effective under the DMCA, your written notice must include substantially all of the following (see 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it — typically the full URL of the album or item on MyAlbumLink.
- Information reasonably sufficient for us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Incomplete notices may delay our response. Send the notice by email to dmca@myalbumlink.com or by mail to the Designated Agent address above.
4. Counter-Notification Procedure
If you are a MyAlbumLink user whose content has been removed as a result of a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing (see 17 U.S.C. § 512(g)):
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which MyAlbumLink may be found, and that you will accept service of process from the person who submitted the original notice (or an agent of such person).
If we receive a valid counter-notification, we will forward a copy to the original complainant. Unless the complainant files an action seeking a court order against the content provider within ten (10) to fourteen (14) business days of receipt of the counter-notification, we may restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA and applicable law, MyAlbumLink has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Generally, an account may be terminated if the user is the subject of multiple valid DMCA takedown notices within a rolling 12-month period. We may also limit access to the Service or terminate accounts of any user who infringes intellectual property rights, regardless of whether there is any repeat infringement.
6. Misrepresentations
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages — including costs and attorneys' fees — incurred by us or by the alleged infringer, the copyright owner, or the copyright owner's authorized licensee. Please do not submit false claims.
