Terms of Service

1. Acceptance of Terms

Welcome to MyAlbumLink ("the Platform", "we", "our"). By accessing or using MyAlbumLink, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and MyAlbumLink. By creating an account, uploading content, or using any feature of the Platform, you confirm that you have read, understood, and accepted these Terms.

2. Description of Service

MyAlbumLink is a web platform that allows users to create, host, and share multimedia albums of properties, spaces, events, and more. Services include:

• Uploading and optimization of photos and 360° panoramic images
• Hosting of videos, PDF documents, and 3D models
• Creation of multimedia albums with multiple content types
• Generation of shareable links
• Importing files from Google Drive (read-only access, optional)
• Link cards to external resources
• Storage and hosting of multimedia content

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years of age to use MyAlbumLink. If you are under 18 years of age, you may not create an account or use the Platform. By registering, you represent and warrant that you are at least 18 years of age.

3.2 Account Information

To use certain features, you must create an account through our authentication provider (Clerk). You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your login credentials
• Update your account information when necessary
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Note: Your password is securely managed by Clerk and is never stored on our servers.

3.3 Prohibition of Multiple Accounts

You may not create multiple accounts to circumvent restrictions, usage limits, or any other security measures implemented by MyAlbumLink.

4. Acceptable Use

4.1 Permitted Use

You may use the Platform to:

• Create multimedia albums of properties, spaces, events, and projects
• Share albums with clients, prospects, or the general public
• Promote real estate, tourism, event, or personal portfolio services
• Legitimate commercial purposes related to real estate, hospitality, events, and portfolios

4.2 Prohibited Use

You agree NOT to:

• Upload illegal, fraudulent, defamatory, obscene, or inappropriate content
• Infringe on the intellectual property rights of third parties
• Publish content that violates the privacy of third parties without consent
• Use the Platform for spam, phishing, or malicious activities
• Attempt unauthorized access to systems, accounts, or data
• Interfere with the normal operation of the Platform
• Reverse engineer or attempt to extract source code
• Use bots, scrapers, or automated tools without permission
• Upload viruses, malware, or malicious code
• Make excessive use that affects performance for other users
• Resell or redistribute the service without authorization
• Impersonate another person or organization

5. User Content

5.1 Content Ownership

You retain all ownership rights to the content you upload to MyAlbumLink ("User Content"), including photos, videos, 360° images, documents, 3D models, titles, descriptions, and other materials.

5.2 License Granted to MyAlbumLink

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:

• Host, store, copy, and display your User Content
• Optimize, process, and convert images (WebP, thumbnails)
• Transmit and distribute your User Content according to your settings
• Create backups of your User Content
• Use your User Content to improve the Platform

This license terminates when you delete your User Content, except that a 30-day retention period is permitted for backups and technical deletion.

5.3 Content Representations and Warranties

By uploading User Content, you represent and warrant that:

• You own or have all necessary rights to the content
• The content does not infringe on the intellectual property rights of third parties
• You have obtained all necessary permissions from individuals who appear in the content
• The content complies with all applicable laws
• The content does not contain confidential or sensitive information without authorization

5.4 Content Responsibility

You are solely responsible for all User Content that you publish. MyAlbumLink is not responsible for content published by users. We reserve the right to review, modify, or remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion.

5.5 Content Monitoring

We are not obligated to monitor User Content, but we reserve the right to do so. If we become aware of illegal or inappropriate content, we may remove it without prior notice.

6. Intellectual Property

6.1 Platform Ownership

MyAlbumLink and all its content, features, and functionality (including but not limited to design, text, graphics, logos, source code) are the property of MyAlbumLink or its licensors and are protected by the intellectual property laws of Mexico and international treaties.

6.2 Trademarks

"MyAlbumLink" and all related logos are trademarks of MyAlbumLink. You may not use our trademarks without our prior written consent.

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform exclusively for the purposes permitted in these Terms. This license does not include:

• Right to resell or commercially use the Platform
• Right to copy, modify, or create derivative works
• Right to reverse engineer
• Right to extract data through scraping or mining

7. Usage Limits and Technical Restrictions

To ensure the performance and availability of the Platform for all users, we implement the following technical restrictions:

• File size: Maximum 50 MB per file
• Rate limiting: Request limits per minute to prevent abuse
• Accepted formats: Images (JPEG, PNG, WebP), Videos (MP4, WebM), Documents (PDF), and links to 3D models
• Items per album: Subject to limits based on your service plan

We reserve the right to suspend or limit access for users who exceed these limits or make excessive use of resources.

8. Privacy and Data Protection

Your privacy is important to us. Use of the Platform is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By accepting these Terms, you also accept the practices described in our Privacy Policy.

9. Third-Party Integrations (Google Drive)

The Platform allows you to optionally connect third-party services, such as Google Drive, to import files into your albums. By using these integrations:

• You accept the terms of service of the corresponding provider (for example, the Google Terms of Service)
• You authorize MyAlbumLink to temporarily access the files you select through the provider's APIs
• You are responsible for having the necessary rights to the files you import
• MyAlbumLink does not store credentials or maintain persistent access to your third-party accounts

10. Payments and Billing

10.1 Free and Paid Services

MyAlbumLink may offer both free and paid services. Specific payment terms, pricing, and features vary depending on the selected plan.

10.2 Billing

When subscribing to a paid service:

• You authorize automatic charges to your payment method
• Charges are billed in advance according to the billing period
• Prices are subject to change with 30 days prior notice
• You are responsible for all applicable taxes

10.3 Refunds

All payments are non-refundable, except where required by law or at our sole discretion.

10.4 Cancellation

You may cancel your subscription at any time from your account. Cancellation will be effective at the end of the current billing period.

11. Termination and Suspension

11.1 Termination by User

You may terminate your account at any time through your account settings or by contacting us. Upon termination, we will delete your content in accordance with our retention policies.

11.2 Termination by MyAlbumLink

We may suspend or terminate your access to the Platform immediately, without prior notice, for any of the following reasons:

• Violation of these Terms
• Fraudulent or illegal conduct
• Request from legal authorities
• Threat to the security of the Platform or other users
• Non-payment for contracted services
• Prolonged account inactivity (more than 2 years)

11.3 Effects of Termination

Upon termination:

• Your access to the Platform will cease immediately
• Your User Content may be deleted according to our policies
• You will not be entitled to refunds for payments already made
• Certain obligations and limitations of liability will survive

12. Warranties and Disclaimer

12.1 "As Is" Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Without limiting the foregoing, MyAlbumLink does not warrant that:

• The Platform will operate without interruptions or errors
• Defects will be corrected
• The Platform is free of viruses or harmful components
• The results obtained will be accurate or reliable
• The quality of service will meet your expectations

12.2 Service Availability

We strive to keep the Platform available, but we do not guarantee 100% availability. We may experience downtime due to maintenance, updates, or circumstances beyond our control.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MyAlbumLink AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages caused by third-party User Content
• Loss of content due to deletion, corruption, or backup failure
• Costs of acquiring substitute services

In any event, our total liability shall not exceed the amount you have paid to MyAlbumLink in the 12 months preceding the event giving rise to the claim, or $100 USD (or its equivalent in MXN), whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless MyAlbumLink and its affiliates, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to:

• Your use of the Platform
• Your User Content
• Your violation of these Terms
• Your violation of third-party rights
• Any fraudulent or illegal act committed by you

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without giving effect to any principles of conflicts of laws.

15.2 Jurisdiction

Any dispute related to these Terms or the Platform shall be resolved in the competent courts of Mexico. You agree to submit to the exclusive jurisdiction of such courts.

15.3 Amicable Resolution

Before initiating any legal proceedings, the parties agree to attempt to resolve the dispute through good faith negotiation. Contact us at admin@myalbumlink.com to initiate this process.

16. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we make significant changes, we will notify you through:

• Email to your registered address
• Prominent notice on the Platform
• Notification in your dashboard

Your continued use of the Platform after the effective date of the modified Terms constitutes your acceptance of the changes. If you do not agree with the changes, you must stop using the Platform and close your account.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyAlbumLink regarding the use of the Platform.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17.3 Waiver

No waiver by MyAlbumLink of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, pandemics, epidemics or disease, strikes, or failures of telecommunications, internet, or hosting services.

17.6 Survival

The following sections shall survive the termination of these Terms: Intellectual Property, Warranties and Disclaimer, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.
